TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using the StormPull API and website (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

StormPull provides a REST API that delivers historical hail and severe storm data sourced from NOAA (National Oceanic and Atmospheric Administration). The Service geocodes addresses and returns storm event data for locations within the continental United States (CONUS).

3. Accounts and API Keys

  • You must provide a valid email address to create an account.
  • You are responsible for safeguarding your API key. Do not share it publicly or embed it in client-side code.
  • You are responsible for all activity that occurs under your API key.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to:

  • Exceed the rate limits of your plan or attempt to circumvent rate limiting
  • Use the Service for any unlawful purpose
  • Resell or redistribute raw API data as a standalone dataset
  • Attempt to reverse-engineer, decompile, or extract our proprietary data processing methods
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated means to create accounts or generate API keys

5. Plans, Billing, and Payments

  • Free Sandbox accounts include 250 total lookups with no expiration.
  • Paid plans are billed monthly through Stripe. Prices are listed on the Pricing page.
  • Lookups exceeding your plan's included amount are billed as overage at the per-lookup rate for your plan.
  • You may cancel at any time through the Stripe billing portal. Cancellations take effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice.

6. Data Accuracy and Disclaimer

StormPull provides storm data sourced from NOAA public datasets. You acknowledge that:

  • MESH (Maximum Estimated Size of Hail) is a radar estimate, not a ground measurement. Actual hail sizes may vary.
  • Storm Events data is compiled from multiple sources with varying levels of precision.
  • Geocoding accuracy depends on the quality of the address provided.
  • The Service is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of accuracy, completeness, or fitness for a particular purpose.

7. Limitation of Liability

To the maximum extent permitted by law, StormPull shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Intellectual Property

The StormPull name, logo, website design, and proprietary data processing are our intellectual property. The underlying NOAA data is public domain. You retain all rights to applications you build using our API.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance with reasonable notice. We are not liable for downtime caused by factors outside our control, including NOAA data availability, third-party hosting providers, or force majeure events.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections regarding liability, disclaimers, and intellectual property survive termination.

11. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or a notice on our website. Continued use of the Service after changes constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts located in Dallas County, Texas.
